These general conditions relate to services provided by bvba Transfo Dive Tank that are provided to consumers (hereinafter ‘customer’ or ‘the customer’).
These general terms and conditions apply, to the exclusion of the terms and conditions of third parties, apply to every delivery of products and services by Transfo Dive Tank to the customer.
The applicability of other general terms and conditions (including those of the client) is excluded. Deviating conditions only apply insofar as they have been expressly accepted by Transfo Duiktank in writing and apply only to the relevant agreement.
These general conditions are supplemented by the general house rules of Transfo Dive Tank and are with them expressly accepted by the client.
The house rules are posted on the website and can, if desired, be requested at the counter of the branch. The client is obliged to comply with these house rules to be observed.
Transfo Dive Tank may at all times refuse or deny access to persons if their behaviour gives cause to do so.

Entry tickets can always be purchased online via the website www.duiktank.be
At the time of booking, a deposit of 50€ or the full amount immediately via online payment into the account of the Transfo Dive Tank. The customer is not entitled to any delivery of services by Transfo Dive Tank before full payment of the amount due has been made to Transfo Dive Tank.
Customer’s payment must be made net to the bank account of Transfo Dive Tank, without any discount, deduction or set-off.

The customer is entitled to have the reservation cancelled free of charge by him/her cancel over a period of 8 calendar days before the date of reservation
Cancellation of the reservation must be made by means of an unequivocal statement via an e-mail addressed to the address info@duiktank.be. Transfo Dive Tank will promptly confirm via e-mail the of the receipt of the cancellation.
Transfo Dive Tank undertakes to refund the full amount paid at the time of the reservation was paid, within 14 calendar days. In case of cancellation less than 8 calendar days before the diving session, Transfo
Dive Tank shall be entitled to retain the full amount paid at the time of reservation to cover the cancellation fee.
In case of cancellation by the client, Transfo Duiktank is entitled to make new reservations for the period in question.
In respect of all divers, Transfo Dive Tank reserves the right to refuse access if no valid diving certificate and diving insurance present.

Transfo Dive Tank exerts itself to the best of its knowledge and ability in the
performance of its duties.
Transfo Dive Tank excludes any liability to its client or
any third person, with the exception of its possible
liability towards its client for intent or gross negligence on the
account of Transfo Dive Tank or its appointee.
Transfo Dive Tank shall not be liable to the customer for any damage as
consequence of any default by the client in complying with the domestic
regulations.
Each client is personally responsible for personal accidents and their
personal property.
Neither Transfo Dive Tank nor its employees can be held responsible
be held responsible for the loss, damage or theft of goods on
the territory of the establishment. Property must at all times
be stored in the designated lockers.

If any provision of these general terms and conditions or the agreement is is invalid for any reason, the provisions herein shall remain in force for the remainder otherwise remain in force.

All agreements concluded by the parties are governed by Belgian law.

In the event of disputes, only the Belgian courts, more specifically
the Court of First Instance of West Flanders, Kortrijk Division, and
the Justice of the Peace of Kortrijk are competent.
The agreement and the obligations contained therein are deemed to have been
concluded at Zwevegem.
